  • Does a living trust protect me from being sued?

    Our living trust is an instrument designed to avoid probate. It is not a shelter to protect against lawsuits.

  • What is probate?

    It is a court process that people have to go through to transfer real estate from a deceased loved one, unless it is set up ahead of time to avoid it. This process is very time consuming as it usually takes over a year to complete and can cost tens of thousands of dollars.

  • I see trusts for $500-600, why is your trust more?

    Along with preparation of the trust, we offer more of a concierge service where we explain the documents in detail and answer questions you may have. The trust is prepared by an experienced legal document professional that is registered and bonded by the state. We also are available to walk you through your finished document once it's complete.

  • What information or documents do we need to have before getting started?

    No specific documents are needed, we merely need the names, addresses and phone numbers of who you want to list as your successor trustees (& agents for power of attorney) and the names of your beneficiaries.

  • What are the benefits of a living trust vs a will?

    Our trusts are mainly to avoid probate, however, trusts in general provide for management of the assets you place into it. A trust is to function during your life and after death. A will does not avoid probate and only provides for the distribution of all your assets after your death.

  • What is a pour-over will vs. a regular will?

    A pour-over will functions in conjunction with a trust, in case any assets are left out of the trust and/or assets are discovered after you have died. Those assets will be distributed according to your trust (as the beneficiary of your pour-over will is your trust). A regular will distributes your assets to the people named in your will.

  • What is the difference between a living trust and a will?

    A will names your beneficiaries to whom your assets go to after your death. A will does not avoid probate in California. A trust manages your assets during your lifetime and after death through the trustee. A will only takes effect after your death, a trust can manage your assets while you are living. A trust avoids probate in California.

  • Can I change something in my trust? If so, I want to change my POA and AHCD. Is that ok?

    Depending on the details of the trust, you most likely can change your trust. We can prepare new powers of attorney and advance health care directive if you need to change those as well.
